General ordering terms luxtehnikapood.ee (VIK AV OU) e-shop
1.1 The present terms are applicable for all legal relations arising between all persons and VIK AV OU, the owner of www.luxtehnikapood.ee (hereinafter referred to as luxtehnikapood.ee e-shop) as a result of purchasing the products from luxtehnikapood.ee e-shop.
1.2 In addition to the present terms, the legal relations arising as a result of purchasing the products from luxtehnikapood.ee e-shop are regulated by applicable legislative acts of Estonian Republic.
1.3 In order to provide the best and most secure service and for the benefit of luxtehnikapood.ee e-shop development, luxtehnikapood.ee (VIK AV OU) has the right to amend and supplement the present terms as well as luxtehnikapood.ee (VIK AV OU) price list. All terms and pricing changes will be published online on luxtehnikapood.ee website. Terms and pricing changes come into effect immediately after their publication on luxtehnikapood.ee website. Should the order be placed before the terms change have occurred, the legal relations between the client and luxtehnikapood.ee (VIK AV OU) are to be regulated according to the conditions which were in force at the time of placing the order, unless provided otherwise by law or the present terms.
2.1. Luxtehnikapood.ee e-shop price list is valid for timely paid invoices according to section 4 of the present terms.
2.2. All prices in online shop in Euro (EUR) and include Value Added Tax (VAT) 20%.
3. Shopping cart and order placement
3.1. You can change the number of items you order. To confirm changes click "update" button. To proceed with payment click "next".
3.2. On the next page you will be asked to enter the billing info. Fill in the buyer's credentials and click "next". On the next page you will have to confirm the order and choose the payment method.
3.3. Please double-check the billing and shipping information, since quick and uninterrupted delivery of your order depends on the accuracy of the info submitted.
3.4. The contract enters into force the moment the payment is transferred to VIK AV OU bank account.
4. Paying for an order
4.1. Please choose the suitable payment method on the billing page.
4.2. Order can be paid for using the following options:
1) Using internet-banking (Swedbank, SEB, Danske… ).
2) Using invoice. On the order confirmation page click "request an invoice". The order confirmation will be sent to your e-mail address, the invoice will be sent after the payment.
3) Using credit card.
4.3. Should the placed order not be paid for in 5 days period, it will be cancelled.
5. Delivery and acceptance
Our delivery services include only the territory of the Republic of Estonia. If you want our side to deliver outside of the previously mentioned area will be the conclusion of a special agreement with a desire to please contact your e-mail address email@example.com .Before sending ordered goods, all technically sophisticated goods passes obligatory quality check on the performance, appearance and integrity of the assembly.
5.1. After the contract has entered into force according to sect. 3.4, the ordered product will be delivered to address specified in the order. The time of delivery will be arranged with the customer in advance by telephone specified in the order.
5.2. The courier will deliver the product along with the necessary documents within the time period specified in the product card. Please find a detailed information on delivery and delivery time:
5.3. Should the ordered product be out of stock and subject to special order from the supplier, and cannot be possibly delivered in time period specified in the product card, as well as other situations where the timely delivery is not possible due to circumstances which VIK AV OU cannot be held responsible for, we will inform the customer by telephone or e-mail specified in the order in 2 business days period from the moment the contract becomes operational according to sect. 3.4 of the present Terms, and will arrange a new product delivery time.
Should you lose your interest towards the product due to an excessive delivery time, you have the right to cancel the order (see sect. 6.1. and 6.3. for more info), and we will refund the sum you paid for the product along with the transportation costs. When purchasing products on order, you will receive an invoice for the 50% prepayment.
5.4. After the ordered product is passed to the courier, the latter will arrange the delivery time with you in advance. 5.4. The courier will deliver the product to address specified in the order. Delivery address cannot be changed after the order is placed.
5.5. Please double check the billing and shipping info in order to prevent delays and discrepancies while delivering the product. Luxtehnikapood.ee (VIK AV OU) and the courier are not responsible for delivery delays and discrepancies should such delay or discrepancy be caused by inaccurate or incorrect data submitted by the customer.
5.6. The courier delivers the ordered product along with the delivery note. Before signing the delivery note, please check the package condition. To confirm the delivery of the consignment, the Recipient, his or her representative or a person appointed by the Recipient shall sign a corresponding confirmation of delivery on a touch-sensitive screen and/or paper. If the package appears to be damaged while transporting, please make a relevant record on the delivery note. We recommend to make a photo of the damaged goods and send it to firstname.lastname@example.org and contact the client service immediately via phone +3726741 841. Products damaged during transportation will be replaced.
6. Cancelling the order and returning the product
6.1. You have the right during 1 day after paying for the product, but before product delivery, to cancel your order by sending a corresponding message along with order number and your bank account number to luxtehnikapood.ee e-shop e-mail address email@example.com or by calling the client support number +372 6741 841.
6.2. After receiving the product you have the right to familiarize yourself with it during 14 days’ time. If for some reason you are not satisfied with the purchased product, you have the right to return it in 14 days’ time by sending a corresponding message along with order number, your bank account number and the address where the returned products are located to luxtehnikapood.ee e-shop e-mail address firstname.lastname@example.org or by calling the client support nr. +372 6741 841. Body care and hygiene products, computer / games, computer software, as well as activated / registered GPS navigation devices are not subject to product return policy.
6.3. Return policy does not apply to products ordered in accordance with client's personal specifications or according to conditions set out by the client.
6.4. When cancelling the order according to sect. 6.1, or when returning the product according to sect. 6.2, the client is returned the sum paid for the order, with the deduction of the fee associated with sending the product back to the warehouse in amount of up to 10 € (see sect. 6.6). The due sum is to be transferred to the client's bank account not later than 30 days after receiving the client's return claim, provided the product has been returned by the same deadline, except for provisions stated in sections 6.5, 6.6 and 6.7.
6.4. The returned product must be fully complete, in original packaging (should contain all the items contained in the product packaging: cables, plastic bags, polystyrene foam packaging, etc.). Should the product be purchased during a campaign with some other product bundled with it, the whole bundle is to be returned (i.e. all the products).
6.5. When returning the product, the luxtehnikapood.ee e-shop retains the right to demand the transportation fee from the client in amount of up to 10 € and to deduct the transportation fee from the sum due to be returned
6.6. Should the returning product (and/or product packaging) be degraded, and should such degradation (i) be caused by circumstances, which VIK AV OU cannot be held responsible for, or (ii) be caused as a result of an inappropriate usage, VIK AV OU has the right to deduct the sum of product degradation from the sum paid by the customer and due to be refunded. To make a deduction, VIK AV OU will send a deduction application to the customer’s e-mail address specified in the order. Should the customer not agree with the amount of deduction, he or she has the right to involve an independent expert to determine the amount of product’s degradation. The cost of expertise is splinted equally between the customer and VIK AV OU, unless one of the parties has claims, which are obviously unreasonable. In this case the cost of expertise is to be borne by the party, whose claim is obviously unreasonable.
7. Return of the products not meeting the requirements
7.1. luxtehnikapood.ee (VIK AV OU) is responsible for all inconsistencies and defects, which appear in 2 years’ time (for physical persons) / in 1 year time (for legal persons), starting from the moment of product acceptance.
7.2. luxtehnikapood.ee (VIK AV OU) is not responsible for:
a) Damage or degradation of the product caused by the client or the third party.
b) Defects caused by inappropriate use of the product.
c) Normal physical wearing caused by the normal usage.
7.3. Should the product be defective or not meet the requirements, the customer has the right to demand the product to be replaced with the product meeting the requirements and free of defects, or revoke the order and return the product not meeting the requirements to luxtehnikapood.ee VIK AV OU.
7.4. Should the product not meeting the requirements be returned, the sum paid for the product (including the transportation costs) will be refunded no later than 30 days after revoking the order and receiving the notification on revoking the contract.
7.5. Apart from the rights subsequent to the guarantee terms, the client also has other rights in accordance with the applicable legislative acts in force.
8. Liability and Force Majeure
8.1. luxtehnikapood.ee (VIK AV OU) and the customer are mutually liable for any damage caused to another party by not complying to the present terms in amount and in cases provided for by the applicable European Union legislative acts.
8.2. luxtehnikapood.ee (VIK AV OU) is not responsible for the damage incurred to the customer as well as product delivery delays, should such damage or delivery delay be caused by circumstances beyond luxtehnikapood.ee (VIK AV OU) control, and occurrence where of luxtehnikapood.ee (VIK AV OU) did not foresee and could not have possibly foreseen (Force Majeure).
9. Other conditions
9.1 Principles of data protection and processing
9.1.1. All the personal data, submitted by the customer while visiting and effecting purchases in luxtehnikapood.ee e-shop are considered confidential. A protected data transmission channel with the bank guarantees the security of personal data and bank transactions. Luxtehnikapood.ee e-shop has no access to these data.
9.1.4.The Purchaser is entitled to withdraw their consent for the use of their data for marketing purposes at any time by sending a corresponding e-mail to the Seller, or to decline further direct marketing offers by following the instructions in a direct marketing offer sent to their e-mail address.
9.2. All matters not covered by the present terms are to be resolved based on the applicable legislative acts of Estonian Republic.
9.3. All the disputes between the customers and luxtehnikapood.ee (VIK AV OU) regarding ordering and buying products from luxtehnikapood.ee e-shop are to be resolved by negotiations. Should the compromise not be reached, the Parties have the right to turn to Customer Protection Department or Tallinn City Court in order to protect their rights. The Parties shall rely upon the applicable legislative acts of Estonian Republic while resolving disputes.
10.1 All the images are for illustrative purposes only.
10.2 Product price and stock status can change with no prior notice.
10.3 We reserve the right to cancel an order with incorrect data, such as typing errors, technical problems or mass ordering. In case of an obvious price error luxtehnikapood.ee e-shop may allude to an error. Namely, if there has been an obvious mistake, the customer should realize the error (for instance, if the TV that costs €1000 is for sale at €100). All the advertised products can only be ordered 1 item per client. The "limited amount" or similarly marked products can be ordered only 1 item per client.
10.4 The product info is checked and updated on a regular basis. The info could have been changed since your last visit. On rare occasions manufacturers’ web pages include inexact data, which may be accidentally transferred to product data page. In this case luxtehnikapood.ee e-shop cannot be held responsible for product data errors.
